General

Only these general terms and conditions shall apply to our sales; any opposing terms and conditions the purchaser may have shall not be recognised by us, even if we do not expressly object to the purchaser’s conditions which are known to us. Our general terms and conditions shall also apply to all future transactions with the purchaser, even if this is not expressly agreed upon again.

All sales to non-german residents oblige to the "United Nations Convention on Contracts for the international sale of goods". For sales to german residents please check the following Terms.

Validity

The choice of goods contained in our catalogues, offers and on our Internet site shall be subject to change without notice. All prices given shall become invalid with the publication of a new catalogue or offer. The validity of the prices offered shall refer only to the stock present at that time.

All prices are per bottle or recipient exclusive of the statutory value added tax (19%).

Shipment units

Mailable case containing 1, 3, 6, 12 or 18 bottles and original wooden box containing 6 or 12 bottles.

Payment

Orders from non-german residents have to be paid via wire transfer before the wines will leave our warehouse or with one of the major credit cards. [Non-Amex] En Primeur invoices have to be paid via transfer within 14 days of receipt or can be paid via credit card adding 4% financial charge.

Reservation of ownership

The delivered goods remain our property until complete payment has been made. This also applies regarding resale to third parties.

Place of fulfilment, passage of risk, shipment

Our registered office shall be the place of fulfilment. We shall ship the goods at the purchaser’s risk from our warehouse to the shipping point desired by the purchaser. If no other address is given, the shipment shall be made to the invoice address. If the shipment is sent by post, the General Terms and Conditions (Allgemeinen Geschäftsbedingungen - AGB) of Deutsche Post AG shall apply in addition to our own. Likewise, in the case of shipment by forwarding agent, the General German Forwarder Conditions (Allgemeine deutsche Spediteur-Bedingungen - AdSP) shall apply.

Complaints

The purchaser is to investigate the goods immediately upon delivery to ascertain whether there is any shortfall or whether any damage, in particular breakage, has occurred during transportation, and to have any shortfall or damage receipted on the consignment note, separated according to types, in order to be able to put forward the corresponding claims against the forwarder.
Optical defects regarding the condition of the bottles shall not entitle the purchaser to make a complaint; this shall apply in particular to the condition of the label, of the capsule and to the fill level in the bottle. Should the purchaser wish, we shall be pleased to inform the purchaser, prior to commissioning and shipment, about the exact condition of the bottles or can send a picture via E-Mail.

Warranties / cork

According to common practice in the industry, no warranty shall be assumed for wines with cork problems, as cork faults constitute an unavoidable risk for which the producers also do not assume any warrantee. In individual cases we shall be happy to look at liberal settlements, but must examine the bottles ourselves and request that the bottles are returned to us quickly.

Subscription

In addition to offers we make which involve the goods being delivered in the short term, we also offer wines in subscription. This means in detail: the wines are to be paid for within 14 days of receipt of our subscription invoice, but the delivery is, however, not usually made until some months / years later. The exact dates are to be taken from the corresponding offers. Should we, due to failure by the upstream supplier, theft, or breakage at the warehouse or during transport, not be able to deliver the wine, the purchaser shall have a claim to reimbursement of the purchasing price plus 4% interest p.a., but not to the delivery of the wine.

Innerhalb Deutschlands erfolgt die Lieferung ab 150 € Rechnungswert frei Haus. Für Lieferungen in das Ausland werden die Frachtkosten zum Zeitpunkt der Auslieferung berechnet.

Place of jurisdiction

The competent local court in Cologne shall be the place of jurisdiction. However, we shall be entitled to take legal proceedings against the purchaser before the court competent for the purchaser.

Green dot

Wines labelled with a green dot and their packaging can, after use, be handed in at the local collection points.

Disposal

With our Partner LANDBELL AG (membership-no.: 45668) we have licensed all our packaging, glasses etc. (Verkaufsverpackung) and you can throw all our packaging in the local Trash Containers in Germany.
